A court case to decide on the rights of farmers to plant genetically modified agricultural products began in the Supreme Court of Western Australia , Monday ( 02/10/2014 ) .
An organic farmer in Kojonup , Western Australia , is suing his neighbor for lost income and property damage after , he says , is contaminated by genetically modified canola ( GM canola ) .
Kojonup , 260 kilometers southeast of Perth , has a population of about 2000 people , mostly farmers who have lived there for many generations to grow crops and raise sheep .
Steve Marsh asked for financial compensation after losing over 70 percent certified organic farmland .
He suspects , properties of materials contaminated by GM canola from property owned by Michael Baxter adjacent in November 2010 .
At that time , Marsh property has organic certification from the National Association for Sustainable Agriculture Australia ( NASAA ) , which should not be contaminated by genetically modified materials .
Marsh argued , GM canola blown up to 1.5 kilometers inside the border fence properties.
